Terms of sale

Karmeli OÜ (registry code 14023884; KMRK: EE101870249), located in Pähkla küla, Saaremaa municipality, Saaremaa, 93874, is the owner of the karmeli.ee webshop (hereinafter the Webshop).

Validity of the sales contract, product and price information

The terms of sale apply to the purchase of goods from the Online Store.

The prices of the products sold in the online store are indicated next to the products. The price includes a fee for delivering the goods.

The fee for delivering the goods depends on the location of the buyer and the method of delivery. The delivery fee is displayed to the buyer when completing the order.

Information about the product is provided in the Webshop directly next to the product.

All prices in the e-shop are in euros and include VAT 22%.

The Buyer can pay for the goods and services in the e-shop via internet banking links or by prepayment based on the order confirmation issued by Karmeli OÜ.

When paying for goods and services using the internet bank link, you must exit the internet bank page by pressing the button «Back to the merchant». Next, the order confirmation will be displayed on the screen.

The order for goods and services is completed and delivered in case of 100% advance payment.

The Buyer's order will be canceled if the Buyer has not paid for the order within 3 working days, except for payment by invoice.

Forming the order

To complete the order, you must fill in the required data fields and choose the appropriate method of product delivery. The amount of the fee is then displayed on the screen, which can be paid via a bank link or using another payment solution.

The contract enters into force from the receipt of the amount to be paid to the online store's current account.

To order the goods, you must add the desired products to the shopping cart. 

If the ordered goods cannot be delivered due to the end of the goods or for some other reason, the buyer will be informed of this as soon as possible and the money paid (including the costs of delivering the goods) will be returned without delay, but no later than within 14 days of sending the notice.

Delivery

Goods are sent to the following countries: Estonia, Finland.  

The shipping costs of the goods are borne by the buyer, and the corresponding price information is displayed next to the shipping method.

Shipments within Estonia generally arrive at the destination specified by the buyer within 3-7 working days, in rare cases up to 14 working days from the entry into force of the sales contract. Delivery outside Estonia takes place within 14 calendar days.

In exceptional cases, you have the right to deliver the goods within 45 calendar days. In this case, we also inform the customer.

Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days (depending on the products, the buyer may not have the right of withdrawal, in this case, the corresponding products and services must be listed and they must meet the conditions listed in § 53 (4) of the Law of Obligations Act).

The right of withdrawal does not apply if the buyer is a legal entity.

In order to use the 14-day right of return, the ordered goods must not be used in any other way than is necessary to make sure of the nature, characteristics and functioning of the goods in a way that is allowed for testing the goods in a physical store.

If the goods have been used for purposes other than what is necessary to verify the nature, characteristics and functioning of the goods, or if they show signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.

In order to return the goods, you must submit a statement of withdrawal from the purchase of the goods, the form of which can be found here: statement of withdrawal and send it to the e-mail address tellimine@karmeli.ee within 14 days of receiving the goods at the latest.

The cost of returning the goods is borne by the buyer, unless the reason for the return is that the item to be returned does not correspond to what was ordered (e.g. a wrong or defective item).

The buyer must return the goods within 14 days after submitting the application or provide proof that he has handed over the goods to the carrier of the goods within the aforementioned period.

Upon receiving the returned goods, the online store will return to the buyer immediately, but no later than 14 days after receiving the withdrawal, all fees received from the buyer under the contract.

The online store may refuse to issue refunds until it has received the item that is the subject of the contract or until the buyer has provided evidence that it has returned the item, whichever occurs first.

If the buyer has explicitly chosen a delivery method other than the cheapest usual delivery method offered by the Online Store, the Online Store does not have to refund the cost to the consumer that exceeds the cost associated with the usual delivery method.

The online store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to an error.

The right to file a claim

The online store is responsible for the non-compliance of the goods sold to the buyer with the contract conditions or a defect that was already present at the time of handing over the item and that appears within one year from the handing over of the goods to the buyer. Within the first six months from the delivery of the item to the buyer, it is assumed that the defect was already present at the time of delivery of the item. It is the Webshop's responsibility to refute the corresponding assumption.

In the event of a defect, the buyer has the right to contact the online store within two months at the latest by sending an e-mail to tellimine@karmeli.ee or calling +372 566 00 334.

The online store is not responsible for defects that have occurred after the goods have been handed over to the buyer.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Webshop will return all fees associated with the sales contract to the buyer.

The online store responds to the consumer's complaint in writing or in a form that enables written reproduction within 15 days.

Direct marketing and personal data processing

The online store uses the personal data entered by the buyer (including name, phone number, address, e-mail address, bank details) only to process the order and send the goods to the buyer. The online store transmits personal data to companies providing transport services in order to deliver goods.

The online store sends the buyer newsletters and offers to the buyer's e-mail address only if the buyer has expressed his wish to do so by entering an e-mail address on the website or has indicated his wish to receive direct mail notifications.

The buyer can opt out of offers and newsletters sent to e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.

Solving arguments

If the buyer has complaints about the Online Store, they must be sent by e-mail to info@karmeli.ee or by calling +372 566 00 334.

If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can appeal to the Consumer Disputes Committee. You can familiarize yourself with the procedural conditions and submit an application here. The competence of the Consumer Disputes Committee is to resolve disputes arising from the contract concluded between the buyer and the Online Store. Review of the buyer's complaint by the commission is free of charge.

The buyer can turn to the consumer dispute resolution platform of the European Union towards.

Karmeli.ee is committed to protecting the privacy of customers and users. Based on this, we have prepared these privacy policy principles, which deal with the collection, use, publication, transmission and storage of customer data. Our activities on the Internet are in accordance with all relevant activities and the relevant legislation of the European Union and the laws of the Republic of Estonia. Collection and use of personal data

Personal data is your data that can be specifically or indirectly associated with a private person, which karmeli.ee collects and processes in order to fulfill the contract concluded with the individual or to contact him or her and to fulfill the obligations arising from the law.

The controller of personal data is Karmeli OÜ, the necessary personal data for making payments is transferred to the authorized processor Montonio Finance OÜ.

The collection of personal data of a regular customer can be done in the following ways:

  • when submitting contact information (including your name, postal address, telephone number, e-mail address) on our website
  •  when using the website from the customer's account information or through cookies
  •  when making a purchase or order in our e-store when storing a person's contact details or data concerning shopping preferences (karmeli.ee may ask you to voluntarily provide personal data and personal information in certain areas of the website. The required personal data may include name, address, postal code, e-mail address, telephone number and other data )

Collection of other data

We also collect non-personalized data - data that cannot be directly linked to a specific person (gender, age, language preference, location).
We may also collect data about customer activities on our website. This data is aggregated and used so that we can deliver more useful information to our customers and learn which parts of the website, products and services are of most interest to us. Aggregated data is treated as non-personalized data in this privacy policy.

Use and storage of collected personal data

With the help of collected personal data, we can inform customers about karmeli.ee product news, campaigns and future events. A customer who does not want to be on our newsletter list or receive notifications about products that may interest him can remove himself from the target group of recipients at any time.

We also use the collected personal data to deliver the goods and to fulfill our obligations to the customer.

By accepting the terms of the privacy policy, the customer gives karmeli.ee consent to the automated processing of their data. You can always withdraw your consent via our website or by making a statement in a form that allows for written reproduction. There is no retroactive effect on the application or withdrawal of consent.

In order to better serve the customer, karmeli.ee may disclose information about individual users to a third party that provides services to karmeli.ee and is contractually obligated to keep the shared information confidential. A third party is, for example, our partner, whose tasks are the transport of goods sold in the e-shop or the provision of an installment payment service.

Karmeli.ee stores the customer's personal data until the regular customer contract is terminated. Karmeli.ee stores data that karmeli.ee is obliged to store as a result of legislation (e.g. accounting data) based on the requirements stipulated in legislation.

Modification of collected personal data

Personal data collected to identify and contact the customer can be viewed, changed and supplemented in the "My Account" section of our website.

If the e-mail (user ID of the karmeli.ee website) changes, please notify us, as it is not possible for the customer to change it himself.

Protection of personal data

karmeli.ee implements all precautions (including administrative, technical and physical measures) to protect the customer's personal data. Only authorized persons have access to change and process data.

If you suspect that your personal data has been handled contrary to what is described in this privacy policy or there is a risk that your data has been leaked to strangers, notify us immediately. This is the only way we can keep the potential damage as low as possible.

The customer has the right to demand the termination of the processing of his data, information about the use of the data and the transfer of data to himself or a third party in a commonly used format. In order to avoid misuse of the customer's data and rights, requests may only be submitted in a form where the applicant's identity can be identified (digitally signed or personally signed at the representative office). We reserve the right to respond to such requests within 30 days.

We treat the request to stop data processing as a statement to terminate the contract of a regular customer.

Security

All personal data of the customer that becomes known in the course of visiting the karmeli.ee e-store and making purchases is treated as confidential information. An encrypted data communication channel with banks ensures the security of the purchaser's personal data and bank details.

By starting to use our website or by filling out the regular customer application, you have read and accepted these principles and conditions. We reserve the right to change the general conditions of the privacy policy if necessary, informing all regular customers, but we do our best to keep our privacy policy up-to-date and available to you on our website.
